For the trip, the Swedish Travel Industry Association's (SRF) general conditions agreed within the industry on June 28, 2018 (revised on May 20, 2021) apply.

Magnus & friends has the right to apply special terms and conditions that deviate from the general ones, if the application of special terms and conditions is justified by the special nature of the trip, special provisions regarding the mode of transport (such as booking and sales conditions for regular flights), deviating accommodation conditions due to the special nature of the trip or special circumstances at the destination. The special terms and conditions may not conflict with the Package Travel Act to the detriment of the traveler.

The general and special terms and conditions are part of the agreement.

1. THE AGREEMENT

1.1 The agreement becomes binding for the parties when the organizer has confirmed the traveler's order in writing, unless otherwise agreed. The organizer must confirm the traveler's order without delay. The right of withdrawal does not apply to package travel agreements.

1.2 The main traveler is the person in whose name the agreement has been made. The main traveler is stated first in the travel documents or in another clear manner. The main traveler is responsible for payment according to the agreement. All changes and any cancellations must be made by the main traveler. Exceptions can be made if the main traveler becomes seriously ill and is unable to carry out the change or cancellation. The main traveler is responsible for providing the organizer with correct booking information for other travelers covered by the agreement. Any refund will be made to the main traveler.

1.3 If the traveler is under 18 years of age and is traveling without a guardian, this must be stated at the time of booking and a consent form for minors must be completed. Some trips may require an age limit that may be higher than 18 years. Information is provided at the time of booking.

1.4 The times for departure and return in the booking confirmation are preliminary. The organizer must specify the departure times that will apply to the trip as soon as possible and if possible no later than 20 days before departure.

1.5 The organizer shall provide general information on passport and visa requirements.

1.6 The organizer shall provide general information on health regulations for the destination.

1.7 Connecting trips or special arrangements are only included in the package travel agreement if they are booked together and at the same time with the services included in the package travel or if they are sold together with other services for a total price.

1.8 Any wishes or special services requested by the traveler are only included in the agreement if they have been expressly confirmed in writing by the organizer.

1.9 The traveler is obliged to check the booking confirmation/travel documents as soon as they are received and that all information is correct, including that the name is spelled correctly and corresponds to the passport. Any errors must be reported as soon as possible. The organizer reserves the right to charge a fee corresponding to the actual cost of correcting incorrect information, plus reasonable compensation for the additional work that the correction entails. If the error is due to the organizer or someone hired by the organizer, the correction shall be made at no cost to the traveler.

1.10 The main traveler shall immediately notify the organizer of any changes to address, e-mail address, telephone number or other information of importance to the organizer's ability to contact the traveler.

1.11 For certain trips, a minimum number of participants is required for the trip to be carried out. In such a case, the traveler shall receive clear information about this at the latest at the time of booking.

1.12 If flight tickets are part of the package trip, these must be used in the correct order. The traveler cannot therefore use only a return ticket when both a return trip and a return flight have been booked or only part of a flight. If the ticket is not used from the start, the remaining parts will be cancelled.

2. PRICE AND PAYMENT

2.1 The price must be stated in such a way that the total cost of the trip is clearly shown. The price shall include all services specified in the agreement as well as mandatory supplements, taxes, and fees.

2.1.1 The organizer reserves the right to correct any typographical errors in brochures or on the website and reserves the right to make changes without prior notice.

2.2 The traveler must pay the total price of the trip no later than the date stated in the booking confirmation.

2.3 The organizer may, in connection with the booking confirmation, charge a first installment (booking fee). The booking fee must be reasonable in relation to the total price of the trip and other relevant circumstances.

2.3.1 The booking fee amounts to 30% of the total price of the trip. For trips that include flights, the booking fee is non-refundable.

2.3.2 The remaining balance (final payment) must be paid no later than 60 days before departure. If the booking is made less than 60 days before departure, 100% of the amount must be paid at the time of booking.

2.3.3 If payment is not received within the specified time, the organizer may cancel the agreement, and the traveler’s place may be forfeited without refund.

3. TRAVELER’S RIGHT TO CHANGES AND CANCELLATION

3.1 The traveler has the right to make changes to the agreement if approved by the organizer. Changes to the agreement may result in additional costs for the traveler, charged by the organizer or a third party.

3.2 The traveler has the right to cancel the trip. The organizer reserves the right to claim compensation from the traveler for any costs incurred as a result of the cancellation. The organizer may establish reasonable standardized cancellation fees based on the timing of the cancellation.

3.2.1 Cancellation fees for the traveler:
– For cancellations made more than 60 days before departure, all payments will be refunded except for the booking fee (30%) for trips that include flights.
– For cancellations made 59 days or fewer before departure, no refund will be issued.

3.2.2 Cancellations must be made in writing by the person responsible for the booking.

3.2.3 All changes to the trip must be made in writing. Agreements made over the phone must also be confirmed in writing.

3.2.4 The organizer recommends that the traveler obtain travel insurance with cancellation coverage, for example through ERV, which may provide compensation in the event of cancellation due to illness, accident, or other unforeseen circumstances.

4. TRAVELER’S RIGHT TO TRANSFER THE AGREEMENT

4.1 The traveler may transfer the agreement to another person who meets all the conditions required to participate in the trip. Such conditions may include, for example, that the transport company or other party contracted by the organizer, in accordance with applicable regulations, must approve the change of traveler.

4.2 The traveler must notify the organizer of the transfer within a reasonable time before departure. Notification made no later than seven days before departure shall always be considered to have been made within a reasonable time.

4.3 The organizer charges an administrative fee of SEK 500 for the transfer.

4.4 The transferor and the transferee are jointly and severally liable to the organizer for any remaining payments for the trip and for any additional costs incurred due to the transfer.

5. CHANGES BEFORE DEPARTURE

5.1 Changes to the terms of the agreement
The organizer has the right to make changes to the agreement, provided that the organizer informs the traveler of the change in a clear, understandable, and transparent manner on a durable medium. If the change is minor — for example, small adjustments to flight times — the traveler is not entitled to a price reduction or compensation. In the event of significant changes to the trip, the traveler must, where possible, be offered an alternative trip or the right to terminate the agreement without a cancellation fee.

5.2 Changes to the price

5.2.1 The organizer may increase the price of the trip if the increase is due to changes in fuel costs, taxes, public fees, or exchange rates.

5.2.2 The price of the trip may be increased by an amount corresponding to the traveler’s share of the cost increase incurred by the organizer. The right to a price increase only applies if the total cost increase exceeds SEK 100 per booking.

5.2.3 The price of the trip shall be reduced if the organizer’s costs decrease, for the reasons stated above, by at least SEK 100 per booking. In the case of a price reduction, the organizer may deduct actual administrative costs.

5.2.4 The organizer must notify the traveler of any price changes as soon as possible. The notification must include a justification for the change and a calculation.

5.2.5 The price may not be increased, nor is there any obligation to reduce it, during the final 20 days before the agreed departure date.

5.2.6 The organizer may, in its specific terms and conditions, waive the right to increase the price under section 5.2.1. In such cases, the organizer is also not required to reduce the price under section 5.2.3.

5.3 Traveler’s right to terminate the agreement without a cancellation fee

5.3.1 If the traveler wishes to terminate the agreement due to a significant change — for example, if the price increases by more than 8% of the total package price — the traveler must notify the organizer of the termination within a reasonable period specified by the organizer from the time the traveler was informed of the change. If the traveler does not do so, they will be bound by the new agreement.

5.3.2 If the package travel agreement is terminated, the organizer must refund the full price of the trip without undue delay and no later than 14 days after the agreement was terminated.

6. CANCELLATION OF THE TRIP AND EXTRAORDINARY CIRCUMSTANCES

6.1 If the organizer needs to cancel the trip, the traveler is entitled to a full refund of the total price of the trip.

6.2 In the event of unavoidable and extraordinary circumstances (force majeure), such as natural disasters, pandemics, or government decisions, the traveler will primarily be offered a voucher or credit corresponding to the value of the trip, which can be used at a later date.

6.3 In the case of a canceled trip, the traveler is not entitled to additional compensation beyond what is stated in this section, unless otherwise required by mandatory law.

Full refund if you get sick before departure
If you, a travel companion, or a family member become ill or injured before departure, you (or your family) will receive a refund through your home insurance, except for any deductible, provided that your insurance covers all family members for illness during travel. If you’re unsure, check with your insurance company.

7. ORGANIZER’S RESPONSIBILITY FOR THE PERFORMANCE OF THE PACKAGE TRAVEL

7.1 Deficient performance
If a travel service is not carried out in accordance with the agreement, the organizer must remedy the defect within a reasonable period of time. However, the organizer is not obliged to remedy the defect if it is impossible to do so, or if such remedy would entail disproportionate costs. If the organizer does not remedy the defect, the traveler may be entitled to a price reduction and compensation.

7.2 Significant defects

7.2.1 If, after departure, a significant part of the agreed services cannot be provided, the organizer shall, if possible, arrange equivalent or at least comparable alternatives at no additional cost to the traveler. If the organizer cannot offer this, alternatives of lower quality may be provided together with a reasonable price reduction. The traveler may only reject such alternatives if they cannot reasonably be considered comparable to those agreed upon, or if the offered price reduction cannot be considered reasonable.

7.2.2 If the organizer cannot offer any alternatives, or if the traveler has the right to reject such alternatives under section 7.2.1, the traveler may be entitled to a price reduction and compensation.

7.2.3 In the event of defects that substantially affect the performance of the package travel and that the organizer has not remedied within a reasonable period, the traveler has the right to terminate the agreement and may also be entitled to a price reduction and compensation.

7.2.4 If the organizer cannot offer any alternatives, or if the traveler has the right to reject such alternatives under section 7.2.1, or if the traveler has terminated the agreement under section 7.2.3, the traveler is entitled to equivalent repatriation without undue delay and at no additional cost if the package includes transport and the traveler is already at the destination.

8. ON PRICE REDUCTIONS AND COMPENSATION

8.1 No price reduction shall apply if the organizer can demonstrate that the defect is due to the traveler.

8.2 The traveler is not entitled to compensation if the organizer demonstrates that the defect is caused by the traveler, or by a third party not involved in the provision of travel services included in the package, or if the defect is due to unavoidable and extraordinary circumstances.

8.3 If the defect is caused by someone engaged by the organizer, the organizer is only exempt from liability for damages under these terms if the engaged party would also be exempt under the same provision. The same applies if the defect is caused by another party in an earlier stage of the supply chain.

8.4 The right to compensation due to trip cancellation does not apply if the organizer can demonstrate that fewer people than the minimum number specified in the agreement have booked the trip, and the traveler is notified in writing within the time period specified in the agreement. Notification of cancellation must be provided no later than:

20 days before departure if the trip lasts longer than 6 days
7 days before departure if the trip lasts between 2 and 6 days
48 hours before departure if the trip lasts less than 2 days

8.5 Compensation under these terms covers pure financial loss, personal injury, and property damage. The traveler is obliged to minimize any damage to the extent possible.

8.6 Unless otherwise limited by the Package Travel Act or other mandatory legislation, the organizer’s liability for damages is limited to three times the price of the package travel. This limitation does not apply to personal injury or damage caused intentionally or through negligence.

9. COMPLAINTS

9.1 The traveler may only claim defects in the agreed services if, within a reasonable time after noticing the defect, they notify the organizer or retailer. This should be done as soon as possible and, if feasible, at the travel destination. When determining any price reduction or compensation for damages, the time of notification will be taken into account, as this could have allowed the organizer to remedy the defect.

9.2 Notwithstanding section 8.1, the traveler may claim defects if the organizer or retailer has acted with gross negligence or in bad faith.

10. TRAVELER’S RESPONSIBILITIES DURING THE TRIP

10.1 Organizer’s instructions
The traveler must follow instructions for the execution of the trip given by the tour leader or any other person engaged by the organizer. The traveler must respect the rules of conduct during the trip and at the destination and behave in a manner that does not disturb other travelers or others. If the traveler significantly violates these rules, the organizer may terminate the agreement without any right to compensation or refund for the traveler.

10.2 Traveler’s liability for damages

The traveler is liable for any damages caused by negligence that results in harm to the organizer.

10.3 Traveler’s responsibility for formalities

10.3.1 The traveler is responsible for observing necessary formalities for the trip, such as having a valid passport, visa, vaccinations, and insurance.

10.3.2 The traveler must complete check-in for all transport services included in the package according to the itinerary or other instructions from the organizer or the carrier.

10.3.3 The traveler is responsible for all costs arising from deficiencies in these formalities, such as repatriation due to a missing passport, unless the deficiencies were caused by incorrect information from the organizer or retailer.

10.3.4 The traveler is responsible for reviewing information provided by the organizer.

10.4 Deviation from the arrangement
A traveler who deviates from the arrangement after the trip has started must notify the organizer or the organizer’s representative.

11. ORGANIZER’S OBLIGATION TO PROVIDE ASSISTANCE

If the traveler encounters difficulties during the trip, the organizer must provide appropriate assistance without undue delay. Such assistance may include information about healthcare services, local authorities, and consular support. The organizer may charge a reasonable fee for such assistance if the situation was caused intentionally or through negligence by the traveler.

12. DISPUTE RESOLUTION

The parties should attempt to resolve any dispute regarding the interpretation or application of the agreement on their own. If no agreement can be reached, the dispute may be reviewed by the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, www.arn.se, or by a general court. A dispute can also be submitted via the EU Commission’s online platform: http://ec.europa.eu/odr.
